What is the impact of the High Court's M&S decision?

Planning partner, Stephanie Hall, featured in Property Week discussing the impact of the High Court overturning Gove's M&S decision:

“The judgement reinforces the importance of our plan-based system which strives to create an evidence-led framework for decision making so that it is not left to the whim of the political will of the day, which is perhaps currently the biggest barrier to development.”

She added that Gove’s decision to reject the re-use of an existing building should have been a boost to the government’s net zero agenda, but was instead was “based on a misinterpretation of the NPPF”.

Stephanie has also been featured in BE news, discussing the impact of the High Court ruling to block M&S Marble Arch store plans unlawful:

“The case is a further example of the tension between politics and planning. The secretary of state’s desire to encourage re-use and refurbishment of an existing building would have gone a long way to support the government’s net zero agenda, but was based on a misinterpretation of the NPPF which has been found not to create a presumption in favour of retention.”
